Terms of use

1. Purpose

These terms of use govern the use of the Peanut app and its website, published by Yanis Rozier (Nay Studio), sole trader (see the legal notice). Peanut helps people with allergies find restaurants, thanks to allergen information and reviews from other people with allergies.

The restaurant area is also governed by the terms for restaurant owners. How your data is processed is described in the privacy policy.

2. Acceptance

You accept these terms by creating an account. When they change, the app shows you the new version when it opens: you can accept it, sign out, or delete your account. Browsing the map and restaurant pages without an account remains subject to sections 5, 7 and 8.

3. Access to the service

  • The service is free for users.
  • You must be at least 15 years old to create an account.
  • We do our best to keep the service available, but cannot guarantee it: it may be interrupted, in particular for maintenance.

4. Your account

You agree to provide a valid e-mail address and to keep your password confidential. You are responsible for what is done from your account. If you think someone else has used it, let us know without delay.

5. Allergy warning

Peanut is not a medical device and does not replace a doctor’s advice or the questions you should ask the restaurant.

  • The information shown comes from different sources: public OpenStreetMap data, user reviews, photos of menus and allergen charts, statements by restaurant owners. It may be incomplete, outdated or inaccurate: a recipe, a supplier or a team can change overnight.
  • Before ordering, always confirm your allergies with the restaurant staff, including the risk of cross-contamination.
  • In case of an allergic reaction, follow your emergency plan and call 112 (15 in France). For deaf or hard-of-hearing people in France: 114.

6. Your contributions

You can publish reviews, send photos of menus and allergen charts, suggest restaurants and report content. You agree that your contributions:

  • reflect your real and honest experience;
  • do not contain personal data about other people (a waiter’s name, a photo of a customer…);
  • are not abusive, defamatory, discriminatory or unlawful;
  • are not advertising, and do not concern a restaurant you are connected to (your own or a competitor);
  • for photos, show a menu or an allergen chart that you photographed yourself.

Reviews are published immediately. Photos are published after being checked by the team. The team may verify, hide, reject or delete a contribution that does not follow these rules. Publishing a review also requires your consent to the publication of the health data it contains, asked separately (see the privacy policy).

Licence on your contributions

You keep the rights to your contributions. So that Peanut can display them, you grant the publisher a non-exclusive, free licence, worldwide and for the whole duration of the rights, to reproduce, adapt (crop, re-encode, resize, format) and distribute your contributions in the app, on the website and in the Peanut services.

This licence ends for a deleted contribution. It continues for contributions kept with no link to you after you withdraw your consent or delete your account: detached reviews, approved photos, restaurant suggestions. The privacy policy describes exactly what is kept. You guarantee that you hold the necessary rights to what you publish.

7. OpenStreetMap data

Some restaurants come from OpenStreetMap. This data is © OpenStreetMap contributors and available under the Open Database License (ODbL): www.openstreetmap.org/copyright.

8. Liability

The publisher does its best to make the information shown reliable and its source visible. It is not responsible for content published by users and restaurant owners, nor for decisions made without checking the information with the restaurant (section 5). Nothing in these terms limits the publisher’s liability where the law forbids it.

9. Intellectual property

The app, the website, the Peanut brand and their content, except user contributions and OpenStreetMap data, belong to the publisher. They may not be copied or reused without its consent.

10. End of the contract

  • You can end these terms at any time by deleting your account in the app (Settings, Delete my account).
  • The publisher may suspend or delete an account in case of a serious breach of these terms, after notifying you except in an emergency.
  • An account with no activity at all for two years may be deleted, after a warning sent by e-mail at least 30 days before.

11. Changes to the terms

The publisher may change these terms. Each version shows its date. A new version is shown to you in the app, and only applies to your account once accepted.

12. Governing law and disputes

These terms are governed by French law. In case of a dispute, please first write to us at contact@naystudio.fr to look for an amicable solution. You may also use a consumer mediator free of charge: [TO BE COMPLETED : consumer mediator]. Otherwise, the courts with jurisdiction under the law may be seized.
